Welcome to Guardex Fire Ltd. These Terms and Conditions (“Agreement”) govern the services (“Services”) we provide to our clients (“you”, “your”, or “Client”). By accessing or engaging with our services, you agree to be bound by the following Terms and Conditions, which form a legal agreement between you and Guardex Fire Ltd (“we”, “our”, “us”).

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms and Conditions, you should not engage with our services.

1. INTRODUCTION TO OUR SERVICES

  • Fire Alarm, Testing, and Maintenance

  • Fire Alarm, Emergency Lighting (weekly/monthly testing)

  • Portable Extinguisher Maintenance

  • Emergency Lighting Installation and Testing

  • Fire Safety Compliance and Consultancy

3. OUR COMMITMENT TO SAFETY AND COMPLIANCE

Guardex Fire adheres to all relevant UK fire safety regulations, including BS 5839 for fire alarm systems. Our team is highly trained and experienced to ensure that every service we offer complies with the latest industry standards, keeping you and your property protected.

4. FORMATION OF CONTRACT

A binding contract between you and Guardex Fire is created when:

  • You request our services via phone, email, or website;

  • We provide a written quotation or confirmation of the services to be provided;

  • You confirm your acceptance by making a payment or otherwise engaging with our services.

Once the contract is formed, these Terms and Conditions will apply to all services rendered.

5. SCOPE OF SERVICES

We offer the following services, which will be clearly outlined in your agreement or quotation:

  • Fire Alarm Systems: Installation, testing, and maintenance in accordance with relevant safety standards.

  • Portable extinguishers (PE): Detailed checks of fire PE equipment and recommendations for improvements.

  • Emergency Lighting Systems: Installation and ongoing testing of emergency lighting.

  • Maintenance Services: Regular servicing of fire protection equipment and systems.

  • Consultancy: Expert advice and guidance on fire safety compliance, best practices, and regulations.

6. ACCEPTANCE OF TERMS

By using our services or engaging in a contract, you confirm your acceptance of these Terms and Conditions. Acceptance occurs when you:

  • Request our services via email, phone, or website;

  • Accept a quote or proposal from Guardex Fire;

  • Proceed with payment or engage with our services.

7. PAYMENT TERMS

  • Fees: The price for our services will be outlined in a formal quotation. These fees may vary depending on the scope of the work required.

  • Invoices: Invoices will be issued upon the completion of services or as agreed in a payment schedule.

  • Payment Due Dates: All payments are due within [30] days of the invoice date, unless otherwise agreed.

  • Late Payment Fees: Any overdue payments will incur a late fee of [£25] per month or part thereof.

  • Accepted Payment Methods: Payments can be made via bank transfer, debit/credit card, or other methods as agreed upon.

8. CLIENT RESPONSIBILITIES

To ensure the smooth delivery of services, the Client agrees to:

  • Provide Accurate Information: You must provide all necessary and accurate information to facilitate the proper execution of the services.

  • Grant Access: You must provide reasonable access to the premises for the installation, testing, and maintenance of fire safety systems.

  • Ensure Compliance: You are responsible for ensuring that your premises are compliant with all relevant safety regulations, and for notifying us of any concerns or special requirements.

  • Provide Safe Conditions: The Client must ensure that the work environment is safe for Guardex Fire’s staff to carry out services.

9. SERVICE DELIVERY AND SAFETY

Guardex Fire commits to delivering services that meet or exceed industry standards. Our services will be carried out in strict compliance with relevant fire safety laws and regulations, including:

  • BS5839 for fire alarm systems;

  • Health and Safety at Work Act 1974;

  • Fire Safety Order (2005).

In the case of maintenance visits, Guardex Fire will document all actions taken, and you will receive detailed reports for each service performed.

10. LIMITATION OF LIABILITY

Guardex Fire will take every reasonable step to ensure the quality and accuracy of our services, but we will not be liable for any losses or damages beyond the amount paid by you for the specific service provided. This includes, but is not limited to:

  • Indirect Losses: We are not responsible for loss of profits, business interruptions, or other indirect or consequential losses.

  • Damage to Property: Our liability is limited to the direct damages caused by our negligence, and we are not liable for any pre-existing conditions or damages not caused by our actions.

11. CANCELLATION AND RESCHEDULING

You may cancel or reschedule services by providing written notice at least [12 months] in advance. If you fail to do so, we reserve the right to charge a cancellation fee usually 50% of our contract agreement.

If Guardex Fire needs to cancel or reschedule for reasons outside of our control, such as extreme weather or health and safety concerns, we will notify you promptly and offer alternative dates for service.

12. FORCE MAJEURE

Guardex Fire will not be held responsible for delays or failure to perform due to circumstances beyond our control, including natural disasters, strikes, war, or government restrictions. In such cases, we will make every effort to notify you and offer a suitable alternative.

13. CONFIDENTIALITY

We are committed to protecting your privacy and confidentiality. Any personal or business information shared with Guardex Fire will only be used for the purpose of providing services and will not be disclosed to third parties without your consent, unless required by law.

14. DATA PROTECTION

Guardex Fire adheres to the General Data Protection Regulation (GDPR). We will handle your personal data responsibly and ensure that it is kept secure. For full details on how we collect, use, and protect your data, please refer to our Privacy Policy available on our website.

15. DISPUTE RESOLUTION

In the event of a dispute, we encourage open communication and an amicable resolution. If a resolution cannot be reached, the matter may be referred to an independent mediator. If necessary, legal proceedings will take place in the courts of England and Wales.

16. GOVERNING LAW

These Terms and Conditions are governed by the laws of England and Wales. Any dispute that arises under or in connection with this Agreement shall be resolved in accordance with English law.

17. CHANGES TO TERMS AND CONDITIONS

Guardex Fire reserves the right to amend or update these Terms and Conditions at any time. Any changes will be communicated to you and will take effect immediately upon notice.
